1. Agreement
These terms are an agreement between you and TimecardCheck (“we”, “us”) for your use of timecardcheck.com, including the time card calculator and My Timecard (the “Service”). By using the Service you agree to these terms. If you do not agree, do not use the Service.
2. What the Service does
The Service helps you add up hours, apply common overtime rules and create a timecard you can share. It is free to use and needs no account. We may change, add or remove features at any time.
3. Estimates only, not advice
Results are estimates for your information. They are not legal, payroll, tax or financial advice, and they are not an official payroll record. Overtime rules have exceptions that depend on your job, employer and agreements, which the Service does not know. Your employer’s payroll records and your state labor agency decide what you are owed. Check important numbers with them or with a qualified professional.
4. Your entries and your responsibility
- You are responsible for the accuracy of the times and details you enter and for any timecard you send to others.
- Your entries are stored on your device. You are responsible for keeping a backup. We are not responsible for data lost when browser storage is cleared, a device is lost, or a browser limits storage.
- Only enter information you have the right to share, and do not use the Service to mislead an employer or anyone else.
5. Acceptable use
Do not misuse the Service. This includes trying to disrupt or overload it, sending spam or harmful content through the feedback form, scraping it at scale, or using it to break any law.
6. Feedback
If you send us suggestions or ideas, you allow us to use them to improve the Service without any obligation to you.
7. Our content
The Service, including its design, text, logo and code, belongs to TimecardCheck and is protected by law. You may use the Service and the timecards you create for your own work. You may not copy or resell the Service itself.
8. Third-party services and links
The Service uses and may link to services run by others, such as your email or messaging apps when you share a PDF. Those services are covered by their own terms, and we are not responsible for them.
9. No warranty
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service will be error-free or always available.
10. Limitation of liability
To the fullest extent the law allows, TimecardCheck will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost wages, lost profits or lost data, arising from your use of the Service. Our total liability for any claim related to the Service is limited to fifty U.S. dollars ($50). Some places do not allow these limits, so they may not apply to you.
11. Indemnity
You agree to cover claims, losses and costs, including reasonable legal fees, that arise from your misuse of the Service or your breach of these terms.
12. Ending use
You can stop using the Service at any time and delete your entries in Settings. We may suspend or end access to the Service, or to the feedback form, for anyone who breaks these terms.
13. Governing law
These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute will be handled in the state or federal courts located in Orange County, California, unless the law where you live requires otherwise.
14. Changes to these terms
We may update these terms. When we do, we will change the effective date above. If you keep using the Service after a change, you accept the updated terms.
